THE LAW. Sexual harassment is a form of sex discrimination under Title VII of the Civil Rights Act of 1964. Although Title VII doesn't specifically mention sexual harassment, it laid the groundwork for the courts and the U.S Equal Employment Opportunity Commission (EEOC) to define how employees may and may not be treated. In addition, most states have their own anti-sexual harassment laws.

The EEOC defines sexual harassment as unwelcome sexual advances, requests for sexual favors, and other verbal or physical sexual conduct in which submission to or rejection of this conduct does at least one of the following: 

  • Affects a person's employment (hiring, firing, promotion). 
  • Unreasonably interferes with a person's work performance. 
  • Creates an intimidating, hostile or offensive work environment.
