Buffalo temp agency accused of just about every kind of bias
If the complaint is correct, Staffing Solutions of WNY in Buffalo has managed to violate just about every law the EEOC enforces.
The EEOC alleges that the temp agency’s owner set the tone by regularly using the racial slurs when referring to black applicants. She also allegedly would refer workers to jobs based on the employer’s racial and gender preferences in violation of Title VII of the Civil Rights Act. She routinely rejected pregnant applicants.
Applicants over the age of 50, disabled applicants and those Staffing Solutions considered disabled also had trouble landing assignments. Staffing Solutions is also accused of violating the ADA and other laws by asking illegal questions about applicants’ health histories and noting their dates of birth. The suit alleges the company rejected older applicants and those with any type of medical history, regardless of their current abilities.
An office manager who opposed the discriminatory practices allegedly was told she would be fired if she continued to complain. Feeling she had no option, she quit.
The EEOC filed suit after failing to resolve the dispute through its conciliation process. The suit seeks back pay, compensatory and punitive damages and injunctive relief designed to end the discriminatory practices.
