Nonsensical complaint? Move for quick dismissal

It can be difficult and even unnerving when a former employee files a lawsuit full of obvious false and unsupportable allegations. But don’t ignore it. Work with your lawyers to get it dismissed as soon as possible. Courts, which are typically overworked and understaffed, do toss out such cases fairly quickly.

Recent case: Vicky has been a New York City corrections officer for about a decade. When an old acquaintance was hired, Vicky began complaining she was being stalked by persons unknown.

Her managers did not believe her, and she was ordered to undergo a medical exam.

She then sued, citing incidents that the court described as unbelievable and paranoid. The judge quickly tossed out the case. (Bey v. Ponte et al., ED NY, 2017)
