In the event of a lawsuit, the legal process can lead your business rather than the other way around. Organizations tend to defer to their law firms—especially when facing a potential crisis—and may fail to manage the process.

It’s not that your lawyers are doing anything wrong. They’re trying their best to help. But when you face an aggressive opponent, the legal costs can be ridiculous and drain money from higher priorities.

Bottom line: Your most effective strategy may be to settle early, even if you’d rather fight. It may mean instructing your attorneys to negotiate rather than defend. If you let the process drag on, it can become a financial albatross and a distraction.
