Q. Can we require job applicants to submit photographs with their résumés and applications?

A. According to the California Code of Regulations, photographs cannot be required as part of the job application unless “pursuant to a permissible defense.” Similarly, according to the EEOC, “employers should not ask for a photograph of an applicant.”

The California Department of Fair Employment and Housing also lists a photograph requirement as an impermissible employment inquiry. There are several reasons for this, including that photographs could be used to discriminate against applicants on the basis of race, ethnicity or both.
