No workers: Still need workers’ comp coverage?

Q. My wife and I run our own business. Are we required to obtain workers’ compensation coverage even though we have no employees?

A. Sole proprietors with no employees are generally not required to provide workers’ compensation benefits, though they do have the option of obtaining workers’ compensation coverage for themselves.

However, if the business hires even one employee, it will need to have workers’ compensation coverage. For more information on who qualifies as an employee and thus triggers your obligation to provide coverage, consult California Labor Code Section 3351.
