This is the final month we depart from our usual format to report questions put to reps from other federal agencies at the American Payroll Association’s Annual Congress, held this year in Nashville, TN.

Issues with Form I-9

Question: Should we inform employees that using a translator requires that the translator complete the Preparer/Translator Certification on Form I-9? When asked, a translator claimed he was having a casual conversation and not providing assistance.

Answer: Yes, inform the employee that the translator must complete his part of the form. It’s clearly a translator’s task if he is explaining the form. You can use the Spanish version of the form as a translation tool. The English version of the form, however, must be completed and retained, except in Puerto Rico.
