Here’s a reminder that even doing the right thing can mean a lawsuit.

Recent case: Florencio complained internally about supposed corruption within his department. Around the same time, two female subordinates started complaining that Florencio was sexually harassing them. One said she had to listen to comments about her physique and her supposed sexual experience. Florencio allegedly asked her to wear high heels to work.

Florencio was terminated for alleged sexual harassment and sued, claiming he was a whistle-blower who had really been terminated for reporting corruption. He said the harassment charges were trumped up to get rid of him.

No dice, said the court, concluding the termination was justified. It tossed Florencio’s lawsuit. (Sauceda v. City of Pearsall, No. 14-51349, 5th Cir., 2015)
