Witten Technologies terminated Anthony DeRubeis and Maclyn Burns. They sued for breach of employment contract. Witten countersued, arguing the two stole trade secrets garnered from their work on Witten’s flagship product.

But Witten ran into trouble when the case got to court. As the discovery process began, the company was so worried about revealing additional secrets that its questions were too vague for DeRubeis and Burns to answer. In effect, Witten wanted the pair to volunteer just what secrets they stole.

The court ruled that Witten will have to actually spell out which secrets it believes DeRubeis and Burns stole so that the two will be able to defend themselves.
