Houston restaurant chain faces EEOC harassment suit

Two former bartenders at Houston’s Berryhill Baja Grill have filed sexual harassment suits against the restaurant, alleging that a manager constantly harassed and groped them—and at least once, exposed himself to them.

Kimberly Kulig and Laura Baatz say they told the manager to stop, and then complained to their immediate supervisor and a regional manager. Eventually, they filed a formal complaint with the corporate office.

The suit claims Berryhill had no sexual harassment policy in place at the time and did not investigate the claims.

The bartenders claim that after they filed complaints with the EEOC, Berryhill assigned Kulig to an unfavorable work schedule and refused to rehire Baatz. Eventually the harassment became so unbearable Kulig was forced to quit.

Barring a settlement in the case, this lawsuit will wind up in court.

Note: Employers that do not have a sexual harassment policy that includes procedures for reporting and investigating harassment are sitting ducks for the EEOC—and juries, should a harassment suit go to trial.
