You must pay promised wages under the Wage Payment Act

When a manager promises an employee a specific wage for doing certain work, the company is obligated to pay that wage after the employee performs the work.

If the employer doesn’t pay, the employee may collect under the New Jersey Wage Payment Act (WPA).

Recent case: Raquell Hatcher worked for Family Dollar Store. Her manager promised her a raise from $9 per hour to $11 per hour if she accepted a promotion to assistant manager.

Hatcher served as assistant manager for two months, but her pay raise never materialized. After she was fired, she sued, claiming among other things that she was entitled to the additional $2 per hour.

The court agreed. It said wages are payments promised in advance of work performed and can be collected under the WPA. (Hatcher, et al., v. Family Dollar Store, No. 08-1444, DC NJ, 2010)
