Charlotte-based Pinnacle Amusements will have to defend itself against charges it created a racially hostile work environment for black workers.

Benjamin Henderson, a driver and warehouse worker, filed the complaint against the company, which rents out amusement park rides for private parties and fundraisers, on behalf of himself and other black employees.

According to the complaint, the owner repeatedly subjected the workers to racial slurs and racially derogatory jokes. Henderson repeatedly asked the owner to stop and was told the jokes were nothing personal.

Henderson filed his complaint with the EEOC, which attempted conciliation. When those efforts failed, the commission filed suit in federal court seeking compensatory and punitive damages as well as injunctive relief.
