U.S. Immigration and Customs Enforcement (ICE) will be conducting I-9 audits of employers performing work on “critical infrastructure” over the winter months.

About 1,000 employers—mainly in defense- and law enforcement-related industries—are being targeted for the audits. ICE is part of the U.S. Department of Homeland Security, which sees immigration enforcement as a critical part of its broad security mission.

Employers that receive notice of an audit should document the date the notice was delivered. The next step: Call an attorney fast, before engaging in lengthy or substantive discussions with ICE personnel.

The new audit crackdown may be a sign of things to come. Employers, even those not associated with critical infrastructure, should check their I-9s on file to ensure they have one for each employee, and that copies of employee documentation are on file. That’s what ICE officials say they’ll be looking for.
