Now is a good time to make sure you have properly posted all required workplace notices where employees can see them. Take inventory and update any posters that have changed as a result of new laws and regulations.

Recent case: Henry Gaillard worked for the Department of Veterans Affairs (VA) until he was discharged.

To begin litigation on any work-related complaints, federal employees have to file an internal complaint within 45 days. Otherwise they lose the right to sue.

The VA could prove it had posted this requirement where employees could readily read it, and Gaillard admitted he had seen the poster.

Still, he missed the deadline. The court tossed out his case. (Gaillard v. Shinseki, No. 09-11949, 11th Cir., 2009)

Advice: Periodically take a photo of your bulletin board (with a date stamp if possible) and file it away in case you need to prove compliance later.
