N.J. troopers challenge mandatory retirement policy

Challenging the state’s mandatory retirement policy, 120 New Jersey state troopers have filed a class-action suit. Under current state law, state troopers must retire at age 55.

The suit calls the policy discriminatory and outdated. Troopers in New York, Massachusetts and Kentucky have won similar lawsuits.

Note: Any policy that has an arbitrary age attached to it is ripe to be challenged in court. It’s exceedingly difficult to prove that every employee suddenly becomes incompetent when they reach a certain age.

Policies that require individual assessments of employees are far easier to defend and more likely to keep good workers on the job.
