Q. We have had some bad weather lately. Is our company liable if an employee has a wreck on the way to work?

Generally, no. An employee isn’t working for an employer when traveling to and from work. Thus, the employee is not the employer’s agent if involved in an accident.

However, if the company paid an employee to pick up other employees on bad-weather days, this employee would be acting for the company and the company would be liable for his negligent driving.
