Q. We need our employees to work longer shifts to meet current production demands. Some employees have objected because this will interfere with their child care responsibilities. Is it legal for us to do this?

A. Generally speaking, no law limits an employer’s ability to require employees to work extra hours. The law requires that only nonexempt employees be paid overtime for all hours over 40 worked in a workweek.

Recently the issue of “family responsibilities discrimination” has gained attention, but a uniformly applied overtime requirement probably would not qualify for such a claim.
