Q. My company does not have a vacation policy. Should it?

A. Whether a North Carolina employer provides vacation benefits to its employees is purely a company policy decision.
North Carolina law does not require employers to provide vacation benefits.

When North Carolina employers do provide vacation benefits, they have significant leeway in defining who is eligible for the benefit, how the benefit accrues, how the benefit might carry over from year to year and how the benefit might be forfeitable.

Note, however, that any policy that requires or results in loss or forfeiture of accrued vacation time or pay, for any reason, must be published to employees in advance, in writing, to be enforceable.
