Wage-and-Hour lawsuits against Pilgrim’s Pride consolidated

Lawsuits filed on behalf of workers at Pilgrim’s Pride poultry processing plants in North Carolina and 10 other states have been consolidated and moved to a federal court.

The lawsuits date back to August 2007, when the U.S. Labor Department sued the company for $3 million in back wages for more than 500 workers. The Labor Department claimed Pilgrim’s Pride failed to pay overtime for the time employees spent putting on and taking off protective gear before and after shifts, and had failed to keep accurate time records since August 2005.

The plaintiffs’ attorneys want to expand the lawsuit to include all current and former hourly workers at Pilgrim’s Pride chicken processing plants since April 20, 2003.

Pilgrim’s Pride said it believes the lawsuit should be dismissed based on recent decisions in other similar “donning and doffing” cases. The company seeks reimbursement for its legal fees.
