Former employees of ousted Anderson Mayor Kevin Smith have filed a lawsuit seeking to keep Smith in office, claiming his successor, Kris Ockoman, did not meet the city’s one-year residency requirement before running for office.

Ockoman maintains he lived for at least a year in an Anderson home, not at his family’s home outside city limits. Smith has said he won’t give up his claim to the mayor’s seat until a judge rules on the lawsuit, despite the fact that Ockoman has been sworn in.

A Madison County judge appealed to the Indiana Supreme Court in January to appoint a special judge to resolve the dispute, saying all the county’s judges believed they had a conflict of interest in the case.
