If your organization is sued, it must turn over related documents, including old e-mails or computer records. New changes to the Federal Rules of Civil Procedure that took effect Dec. 1 place more burdens on you to come clean with what you have.
Most importantly, it requires both parties to federal lawsuits to sit down at the beginning of the lawsuit to hammer out a plan for electronic discovery. Now’s a good time to talk with IT and your attorney about the best practices to retain and purge e-mail.
