Q. We verbally warned an employee not to work overtime. Recently, he claimed to have worked 56 hours straight, eating and sleeping only on regular break times. The timecards say he was here, but we don't have any night staff, so we can't verify if he was actually at work. Is there anything we can do? —S.T., Michigan

A. Generally, if a supervisor or manager knows or has reason to believe that the work is occurring, the employer is obliged to pay for it. That being said, rather than risk being caught up in a lawsuit over refusing to pay for unauthorized overtime, it may be better to deal with this situation by paying the employee and disciplining him for insubordination and violation of company policy.
