When an investigation into a hostile environment sexual harassment complaint reveals that the complaining employee has engaged in some crude behavior of her own, you need to be able to differentiate between run-of-the-mill humor and humor that crosses the harassment line.


Funny Business

The owner of a medical clinic told dirty jokes; talked about oral sex and women's breasts; made sexual comments about female drug representatives who came to the clinic; used terms such as "slut" and "c***" to refer to female employees and patients. He showed an x-ray of his hip to employees and female drug reps, pointing out a shadowy image of his penis, which he called Mr. Happy. In a staff meeting, he talked about his wife's "nice, tight p****." He showed one female doctor vacation pictures that included a photo of topless women (including his wife).
