Westward Trails Rehabilitation and Healthcare Center says it fired Evelyn Jones because she cursed at a patient at the Nacogdoches nursing home. The 67-year-old Jones says she lost her job because of her age and race.

Now Jones, who is black, is suing Westward Trails, contending it subjected older, black employees to different terms and conditions of employment than younger, white employees. She argues that young employees who aren’t black got away with cursing at patients and still kept their jobs.

Jones’ lawsuit seeks reinstatement with full pay, as well as back pay. In addition, she is asking the court for mental, emotional and psychological damages, lost pay, punitive damages, liquidated damages, attorneys’ fees and costs.
