A part time employee is due for her yearly evaluation after her maternity leave; she reschedules the eval 3 times;  after I notified her of her of the steps following a 4th reschedule (go to HR) she gets a note from her OBGYN to extend her maternity leave 2 additional weeks.  her position is part time during a school year and not in the summer months.  I fear that she is trying to pursue a lawsuit for harassment.  My documentation both informal and formal discusses her performance and I also have a PIP.  Question:  how long can this go on?  and does she have a leg to stand on??
