Here’s a reminder for all your supervisors and managers when they are interviewing and selecting potential employees. Tell them they must never promise a job before getting approval.
Doing so may mean a lawsuit if the applicant relies on the promise to his detriment—perhaps by giving notice at a current job or selling a home in preparation for moving.
Recent case: Jimmy Williams was an assistant basketball coach for Oklahoma State University when he claims he was offered a similar job by University of Minnesota head coach Tubby Smith. He sold his Oklahoma home and prepared to leave Oklahoma State. But he didn’t get the Minnesota job.
Williams sued, alleging negligent misrepresentation. The Minnesota Court of Appeals said the case should go to trial. (Williams v. University of Minnesota, No. A08-0765, Minnesota Court of Appeals, 2009)
