California State University Fresno has settled a suit brought by a female former volleyball coach who accused the school of sex discrimination.
The settlement was reached 18 months after a California Superior Court jury returned a $5.85 million verdict in the favor of Lindy Vivas on her claims of sex discrimination and retaliation under federal Title IX rules and the California Fair Employment and Housing Act.
Under the settlement, the university will pay Vivas slightly more than $2.1 million in addition to a 30-year annuity that pays her $5,995 a month beginning in January. The university is also required to pay Vivas’ attorneys an annuity, bringing the total cost of the settlement to approximately $5.2 million.
Vivas had filed her suit alleging sex discrimination, marital status discrimination and perceived sexual orientation discrimination after the university fired her in 2004. Vivas had also claimed that the university retaliated against her for advocating gender equity in school athletic programs.
The parties settled the case before the appeals court could rule on it.
