Hospitality, food service draw the most FLSA lawsuits

The hospitality and food service industries have been the most frequent targets of U.S. Department of Labor wage-and-hour lawsuits since 1985. An analysis of DOL data by payroll software provider TSheets and legal website Lexology.com found that hotels and restaurants came out on the losing end of 29,402 Fair Labor Standards Act prosecutions over the last 30 years.

Overall, DOL attorneys successfully prosecuted almost 120,000 wage-and-hour cases—a somewhat astounding 10 per day for three decades. Fines and back wages recovered total $1.5 billion, with employers in the mining and petroleum industries paying the most per case: $56,900.

Retail: 14,826

Construction: 11,237

Manufacturing: 8,445
