Old City Philadelphia bar Rotten Ralph’s faces charges it discriminated against a Muslim employee when it refused to allow her to wear a khimar or head scarf during Ramadan.
According to the complaint filed with the EEOC, a bar manager interviewed the woman and hired her. She did not wear the khimar during the interview.
Once Ramadan began, she wore the khimar to work. The manager was not on duty during her first several shifts and she worked without incident. When they did eventually work together, however, the new employee was told staff weren’t allowed to wear “hoodies” at work. Then she was fired.
Her EEOC complaint alleged Rotten Ralph’s violated Title VII of the Civil Rights Act by refusing her religious accommodation without demonstrating that doing so would cause an undue burden to the employer.
Advice: Train all managers about religious accommodation. Establish a process to evaluate all religious accommodation requests.
