Absence alone isn’t grounds to deny unemployment comp

Employees discharged for being absent may still be eligible for unemployment compensation. That’s because employees must have committed willful misconduct to lose the right to benefits. An employee fired for missing work because he couldn’t call in or otherwise comply with his employer’s call-off procedure, for example, would still be eligible.

Recent case: Richard was fired from his job as an environmental services aide when he allegedly didn’t show for work and didn’t call and report the absence. Richard filed for unemployment. He claimed that he had called, but no one picked up the phone.

The court denied Richard the benefits because he couldn’t show that he had made the call. He never showed the court any call records. If he had, he could have received the benefits. (Beck v. Unemployment Compensation Board of Review, No. 2001 C.D. 2014, Commonwealth Court 2015)
