In pay case, Supreme Court asks: What is work?

Does standing in line count as work? That was at the core of the Justice’s questions on Oct. 7 as the U.S. Supreme Court heard oral arguments in Integrity Staffing Solutions v. Busk (No. 13-433, U.S. Supreme Court, 2014).

The case involves contract workers assigned to Amazon.com warehouses in Nevada. They’re required to undergo security screenings after their shifts to protect against thievery. The process can take a half hour, and the workers want to be paid. Past Supreme Court decisions have ruled that extra pay isn’t required for activities that aren’t “an integral and indispensable part of the principal activities” of the job.

The workers argue they should be paid because the security measures exist solely for Amazon’s benefit.
