In most cases, employees seeking a promotion or applicants seeking a new job have to actually apply and then be rejected in order to sue over alleged discrimination. Except in very rare cases—when it is obvious that applying would be futile or when the application process is hidden or informal—an application is a prerequisite for a lawsuit.

Recent case: Ann worked for several years on an annual contract basis as an assistant professor at the Ameri­­can University in Cairo.

Professors there typically work for six or seven years before becoming eligible for tenure. At the end of those years, the university requires professors to apply for tenure, showing their qualifications through teaching excellence and scholarship in their field of expertise.
