Even a small gender-based pay differential may become the foundation of a class-action lawsuit.
Recent case: Several women who worked for KPMG sued their employer, claiming that the company systematically paid female professionals less than male professionals doing the same job, having the same experience and working for the same supervisors.
They had an expert analyze years of pay data. The expert concluded that there was a 3% across-the-board gender difference in pay—with women in professional positions earning less than comparable men.
The expert concluded that the chances of the difference not being the result of discrimination was less than one in a million.
The court said the case could proceed as a class action. Now other women will be invited to join the lawsuit. (Kassman, et al., v. KPMG, LLP., No. 11-CIV-03743, SD NY, 2014)
