An employee recently tried to claim that a customer had retaliated against her for griping on the job.
It didn’t work.
Recent case: Dianne was a driver for a trucking company. When a customer made her wait at the loading dock and refused to allow her to use the bathroom inside the store, she complained to the customer’s HR office, claiming she had been treated differently than male drivers.
Shortly afterward, the customer told Dianne’s employer that it didn’t want her to handle their deliveries because she was “obnoxious, rude, had a bad attitude.”
Dianne sued the customer, alleging retaliation for the complaint.
The court dismissed her claim because the customer didn’t employ Dianne. Therefore, it couldn’t have retaliated against her for her complaint. (McIntyre v. Roly’s Trucking, et al., No. 4:14-CV-193-A, ND TX, 2014)
