The EEOC received 93,727 charges in fiscal year 2013, a 5.7% decrease compared to 2012. Charges declined for all types of discrimination except those alleging violations of the Genetic Information Nondiscrimination Act (GINA).
However, retaliation charges grew for the eighth straight year. The 38,539 retaliation charges filed in 2013 set a record, and 41% of EEOC claims now include a retaliation charge, also a record high.
Employees often add a retaliation claim when they allege some form of adverse employment action occurred after they complained about bias.
Besides retaliation, the most frequent charges alleged bias based on race (33,068), sex (27,687) disability (25,957) and age (21,396).
Sex discrimination charges fell the most in 2013, declining 9% compared to 2012. The EEOC includes claims of sexual harassment andin its tally of sex discrimination charges.
