Walmart managers at the chain’s Hamburg store in suburban Buffalo moved quickly after the New York chapter of the Council on American-Islamic Relations alerted it to anti-Islamic Facebook postings by one of its assistant managers. The man was promptly fired.
The assistant manager posted an expletive-filled rant along with a photo of two Muslim women in traditional dress reading: “Halloween came early this year … Do they really have to … dress like that … your [sic] in my country … get off!!!”
Walmartfired the man after confronting him over the posts.
The man later offered an apology in the Buffalo News. He noted that he made posts from his own computer on his own time. The apology and explanation were too little, too late for Walmart, which told the newspaper that it “set high expectations for our associates, and this associate clearly failed to meet these expectations at every level.”
Note: Employers may use social media posting as grounds for termination, but employers should consult an attorney before doing so. The National Labor Relations Act guarantees employees the right to discuss working conditions; employers that discipline employees for doing so violate the law.
