Longview nursing home slapped with retaliation suit

A Tyler nurse is suing the nursing home where she once worked, claiming she was fired in retaliation for filing an EEOC complaint. 

Yvette Shelton, who is black, had worked at the Longview Healthcare Center since October 2004.

She filed a bias complaint with the EEOC in early 2010—but then withdrew it that summer. She thought her complaint had been resolved, since the nursing home fired one of the people she said was discriminating against her, and another had been allowed to resign.

Then in March 2011, Longview Healthcare fired Shelton after a resident under her care wandered away from the facility. The nursing home also justified the termination by contending that Shelton had problems dealing with a co-worker.

Shelton’s lawsuit contends she was fired in retaliation for complaining to the EEOC. She seeks back pay, front pay, reinstatement and restoration of lost benefits.
