Chester Hoist, headquartered in Lisbon, will pay $272,000 for discriminating against an inspector who was disabled on the job.
After a forklift accident crushed his foot, the inspector received workers’ compensation while undergoing rehabilitation. After five years, he notified the general manager that he could return with an accommodation—resting his foot occasionally and readjusting his boot.
The general manager claimed that the inspector’s medical notes led him to believe the inspector was unable to return to work, so he terminated him. The company also argued it could not identify any suitable accommodation for his position.
A jury awarded $12,500 in compensatory damages, $80,000 in back pay, $80,000 in front pay and $100,000 in punitive damages.
