Q. Under what circumstances, if any, can an employer require an applicant or employee to pay for his or her own medical or physical examination?

A. California employers cannot force current employees or applicants to pay for medical or physical examinations required by the employer. The state law further prohibits employers from deducting money from an employee’s wages or requiring repayment by an employee for the costs of a medical or physical examination required by any law or government regulation.

The state Division of Labor Standards Enforcement has stated, however, that employers may require applicants to pay the costs of any pre-employment medical or physical examinations required by law.
