Q. We may soon terminate an employee whose daughter also works here. We’re uncomfortable with her daughter remaining as an employee. Can we legally fire the daughter, as well?
A. There is nothing inherently unlawful in terminating an employee because she is related to a terminated family member.
However, there are a number of issues you should consider before you ask. Why will you be terminating the employee? Is there a business reason justifying the daughter’s termination other than her family relationship? Was the daughter involved in any way in the behavior that led to the mother’s termination? Has this type of situation occurred before and, if so, did you terminate the family member in that situation?
