The New Jersey Supreme Court has ruled that arbitration agreements that exist only in electronic form are valid and binding.

The court decided in Fawzy v. Fawzy (199 NJ 456, Sup. Ct., July 1, 2009) that the agreements need not be in traditional paper form to be valid. As long as the agreement meets all other contractual requirements, it is binding and enforceable.
