Q. When there’s even a hint of bad weather, one of our employees goes home. Can we require her to work until the regular quitting time?

A. Yes. There is no law in North Carolina that permits employees to leave work early due to bad weather. The employer has discretion whether to shorten the workday. It is also in the employer’s discretion whether nonexempt employees will be paid or not for missed time.

Thus, if you have an employee who regularly wants to leave work a the first snow flake, you can require her to continue to work. If she refuses, you can take disciplinary action.

However, it pays to exercise good judgment, so you don't alienate or endanger your employees.
