Q. In New York, can an employee be prohibited from engaging in political activity?

A. New York has a statute, Labor Law 201-D, that prohibits employers from discriminating against employees for off-duty conduct. That includes political activity. Employees are free to engage in such conduct provided it does not conflict with the employer’s material interests.
