Q. If we suspend an employee “pending investigation,” what information must we provide to the employee?

Under Pennsylvania law, there is no requirement for a private employer to provide an employee who has been suspended “pending investigation” with any information concerning the investigation.

However, it is good practice to provide the suspended employee with information regarding the subject matter of the investigation, an estimated time frame in which the investigation will be conducted, as well as potential courses of action following the conclusion of the investigation. The employer should also give the employee an opportunity to tell his or her side of the story.

To the extent it’s consistent with a fair investigation, the employer generally should avoid giving the employee certain details, such as the identities of the employees interviewed during the course of the investigation.
