Three former employees at a Chinese restaurant in Wayne filed a complaint with the National Labor Relations Board (NLRB) alleging unfair labor practices.
The workers had quit their jobs in 2005 to protest wages, hours and working conditions. But when they tried to return to work, their employer said they must first withdraw their complaints.
One of the workers claimed the restaurant didn’t pay him a base wage, forced him to hand over part of his tips to his bosses and penalized him $10 if he made mistakes. The case is one of several pending with the NLRB against buffet-style Chinese restaurants in northern New Jersey.
Advice: Make sure your managers understand why it’s crucial to comply with labor rules. Not only can the NLRB fine your organization, but the U.S. Labor Department will most likely come calling, too. And if that happens, your managers may be personally liable for violating the minimum wage and in the Fair Labor Standards Act.
