Q. Can an employer in Colorado fine an employee who quits without giving two weeks’ notice?

A. Colorado is an “at-will” state, meaning an employer can fire the employee or the employee can quit at any time, with or without notice.

However, there is no law that prevents the employer and employee from entering into an agreement that requires notice, and creates fines for failure to provide notice. Whether an employer can deduct this “fine” from a final paycheck depends on whether the employee agreed in advance to the deduction.
