Q. We have an employee who is serving on a jury. It’s a long case. Do we have to keep paying her for her time off? — P.J., Minneapolis

A.
You are not required to pay her for the time off from work. While many employers have policies providing for compensation during times of jury service, this is not legally required. Employers that provide such benefits often place a cap on the amount of pay an employee may get to minimize the hardship.

If yours does not have a cap, consider changing that. You may want to offer to this employee to use her paid-time-off benefits during the remainder of her leave.
