Q. I understand that it’s illegal to ask applicants certain personal questions. But are there any questions I can’t ask a reference or previous employer?

A. You should refrain from the same sorts of questions that are impermissible to ask applicants. For example, if you ask a prior employer whether an applicant is disabled and decide not to hire the applicant if the answer is yes, then you risk a discrimination claim from the applicant just as you would if you asked the applicant directly.
