Q. I suspect that an employee out on workers’ compensation is lying about the extent of her injury. May I require the employee to have another medical examination?

A. Yes. Any time an employee is claiming weekly indemnity benefits, the employer may request that the employee submit herself to an examination at the employer’s expense. If the employee refuses, benefits may be suspended. Employers should coordinate any request for examination with their workers’ compensation carrier.
