The East Brunswick School District has sued high school football coach Marcus Borden to force him to stop praying with players. Borden argued successfully in lower court that the district violated his free speech rights by ordering him to stop actions he considers secular signs of respect, such as bowing his head. The district now has taken its suit to the 3rd U.S. Circuit Court of Appeals.
The district says Borden is violating a 2005 district policy and the separation of church and state. The court has not indicated when it will rule, but voiced its concern that the parties could not simply work out a solution that made everyone feel comfortable.
